Introduction

With the EU's net-neutrality regulation in place since April 30, 2016, examples of how regulators are implementing the rules are beginning to appear. Noncompliance seems rare across the member states; however, some instances have arisen.

Highlights

  • On February 4, 2019, Ofcom decided to challenge O2's initial response to the regulator's investigation, when it was requested to provide information about its traffic management practices, warning that it had failed to provide accurate and complete answers. Should Ofcom's concern be confirmed, this could call into question the existing regulatory framework, and it may be justified to review the approach.
  • Violations of the law include practices of restricting tethering, throttling traffic, and limiting transparency over zero-rating.

Features and Benefits

  • Evaluates Ofcom's investigation into operator compliance with net-neutrality rules.
  • Assesses the challenges regulators face in regulating net neutrality.

Key questions answered
